This regulation is a replacement of Regulation of the Minister of Finance Number 60/PMK.03/2014 in response to the developments in the mechanisms of information exchange as well as the types of data and information being exchanged. Exchange of information related to taxes based on International Treaties is aimed at preventing tax avoidance, preventing tax evasion, preventing misuse of Tax Treaties by irresponsible parties and obtaining Information related to tax obligations of taxpayers.
Such exchange of information may be reciprocal in nature and is conducted in the form of the exchange of information between Competent Authority in Indonesia and Competent Authority in Partner Countries or Partner Jurisdictions, including exchange of information based on request, spontaneous exchange of information, and automatic exchange of information, and the implementation may be in the form of competent authority meetings, tax examinations abroad or simultaneous tax examinations by Competent Authority. Other sections of this regulation contains detailed provisions which constitute further elaboration of the criteria, implementing procedures and types of information exchanged in the exchange of information based on request, spontaneous exchange of information, and automatic exchange of information, as well as further provisions related to the implementation of competent authority meetings, tax examinations abroad atau simultaneous tax examinations.
This regulation has come into effect as of March 6, 2017.
Regulation 39 PMK 03 2017
